RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT
Brilliant Lifestyles™ programs, training events, and courses are recorded using audiovisual technology. Programs and events may also be photographed. All recordings and photography by Brilliant Lifestyles (the “Materials”) will be used for current and future use of Brilliant Lifestyles for all reasonably necessary business purposes consistent with training, education, and mentoring industry standards. Such use and collection of the Materials may also be used by Brilliant Lifestyles for purposes of marketing to existing and prospective customers, compiling training videos and audio recordings, manuals, and all other training materials for other Brilliant Lifestyles events. The Materials may be used and compiled to create products such as, but not limited to: DVDs, Videos, CDs, internet media and video downloads, interactive audiovisual training materials, and other Brilliant Lifestyles products. Use of the Materials will be consistent with common industry practice. The Materials may be presented to third parties attending Brilliant Lifestyles events, and training programs for the sole purpose of training and mentoring, or presented on Brilliant Lifestyles products available for the purchase of third parties and attendees. Attendance at any Brilliant Lifestyles event is voluntary. By attending and signing this Waiver of Liability you are authorizing Brilliant Lifestyles to use the Materials collected during this event for the purposes described above. You acknowledge and understand that your participation in this event (a) is voluntary; (b) the Materials will be used for the stated purposes herein; (c) you are consenting to Brilliant Lifestyles use of The Materials whether they may or may not contain images of you; and (d) you consent to the use of the Materials by Brilliant Lifestyles as stated herein. By signing this Waiver you are agreeing that at no time has your signature been coerced, and you understand it is a voluntary agreement in order to attend this Brilliant Lifestyles event.
IN CONSIDERATION of being permitted to observe, work for, or participate in any way in the EVENT(S) or being permitted to enter for any purpose any RESTRICTED AREA (defined as any area requiring special authorization, credentials, or permission to enter or any area to which admission by the general public is restricted or prohibited), EACH OF THE UNDERSIGNED, for himself, his personal representatives, heirs, and next of kin:
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
